Are these options Unconstitutional?

There is one item in the RAD initiative that conflicts with the US Constitution. That is item 8, which says the state of Arizona can't extradite people to other states for victimless marijuana crimes.

I'm sure that it's constitution because, the RAD initiative modifies the Arizona Constitution.

But I don't want to have any possible problems, so I'm removing it from the initiative.

There are two items which some non-lawyers think could be conflict with the US Constitution.

I think they are both OK, but asking some lawyers and legal experts to review them.

The first possible conflict is item 6, which says anybody convicted of a victimless marijuana crime should receive an automatic pardon and have their record cleared.

Somebody thinks that's a violation of the ex post facto clause in the US Constitution.

I don't because it pardons people. It doesn't increase their sentence.

The second possible conflict is item 3, which says the Arizona government can't assist any other governments in fighting their war on marijuana or war on drugs.

I don't think that's even possibly could be unconstitutional.

But again I will ask some lawyers and legal experts to review it.

Committee Secretary of State Arizona Clections

Here is some information on the committee we formed for the 2018 initiatives to legalize marijuana and or all drugs.

I think the government's official title for this stuff is Campaign Finance committees.

I suspect because of the 2016 initiatives we filed to legalize marijuana and heroin they actually changed the law to make it harder for us to file theise initiatives.

We also are filing some initiatives to protect the public from crooked police officers.

A conflict with the US Constitution?

Travis Vandenbrul found a conflict in the RAD initiative with the US Constitution.

I don't think this affects the "constitutionality" of the RAD initiative, because after all the RAD initiative modifies the Arizona Constitution. So if it is passed, by definition the RAD initiative would be "constitutional".

Files with initiatives to re-legalize marijana & heroin

These are 6 files for my effort to re-legalize or legalize ALL drugs in Arizona. There are 3 files to re-legalize marijuana in Arizona and there are 3 files to re-legalize heroin, cocaine, LSD, marijuana, methamphetamine ,peyote and all other drugs in Arizona.

Of the 3 files in each set, one file is a text file, the other file is a Word file and the final file is an Open Office file.

After I filed the two initiatives I took photos of the paper work after the Arizona Secretary of State gave me the numbers for each Constitutional initiative.

Mary C Fontes is the person who took the paper work from me and give me the filing numbers.

The number to re-legalize marijuana is C-02-2016 and the number to re-legalize all drugs is C-03-2016. That C-03-2016 is to re-legalize re-legalize heroin, cocaine, LSD, marijuana, methamphetamine ,peyote and all other drugs.

RAD initiatives to relegalize drugs seem to be constitutional

We asked the Arizona Legislative Council to review the RAD initiative to legalize marijuana and they came back and said that it seems to be constitutional.

The only negative thing they said is it conflicts with Federal law, and we all knew that already.

Since the RAD initiative to legalize all drugs is identical to the marijuana initiative we suspect that it is also constitutional.

Some come on folks, let's get this initiative on the ballot and relegalize drugs and end the American police state which has been caused by the "War on Drugs"

RAD initiatives to don't conflict with Federal law

Initially I thought the RAD initiatives to re-legalize drugs conflicted with Federal law, but after thinking about it I changed my mind.

Under Federal law marijuana and other drugs are illegal.

While both of the RAD initiatives have the words re-legalize drugs in then, technically neither RAD initiative legalizes drugs in Arizona.

Both RAD initiatives forbid the state of Arizona from taxing or regulating drugs.

So while the initiates don't legalize drugs with words saying drugs are legal, the initiatives effectively make drugs legal, by forbidding the govenrment of Arizona from regulating them.

And that is why I believe neither RAD initiative conflicts with Federal law.

Final MPP initiative to legalize marijuana in Arizona

If you ask me it's mostly about creating a government monopoly on growing and selling recreational marijuana to make the current owners of medical marijuana dispensaries wealthy.

The agency is a worthless govenrment agency that probably won't help you get your public records.

The only purposes of the Arizona Ombudsman Office is to make the public THINK that they have a right to public records, which you do, but the govenrment won't do jack to help you get those public records.

If the Arizona Ombudsman Office can't help you get your request for public records they will then write a worthless letter to the Arizona Governor saying government agency "XYZ" refused to give you your request for public records.

That's it!!! The worthless folks at the Arizona Ombudsman Office won't sue them for your or do anything else.

Marijuana dispensaries turning in competitors to the police?

From this article it sure sounds like the medical marijuana dispensaries are turning anybody that they consider a competitor into the police and have the police shut them down.

This includes the "farmers markets" and the "compassion clubs", along with medical marijuana care takers and patients who are doing "patient to patient sales" of legal medical marijuana.

They told us that Prop 203 or the Arizona Medical Marijuana Act was to help sick patients, but when you read this article it sounds like it is about MONEY more then helping sick patients.

If the current MPP initiative to legalize marijuana gets on the ballot and is passed I suspect the 150 recreational marijuana shops that are allowed will also be snitches and turning in anybody they thing is cutting into their lucrative $300 an ounce market for marijuana into the police to shut them down.

If you want to stop people from being thrown into jail for victimless marijuana crimes, the MPP initiative is not going to do it.

Initiative waives application fees for medical marijuana use

Here is an initiative by the Arizona Marijuana Patient Society that would waive application fees for medical marijuana use.

It sounds like the folks at Arizona Marijuana Patient Society are good guys who support people right to use marijuana.

Compared to the folks at MPP or Marijuana Policy Project who seem like bad guys who seem to want to make 150 buddies theirs millionaires by giving them a govenrment monopoly on growing and selling recreational marijuana in Arizona.
